16                          INTRODUCTION

17   Defendant CRAIG CANADA is under the medical care and supervision of

18 ROBERT F. STERNER, JR., MD (CA Medical License No G51708) for the

19 treatment of Bipolar Disorder, Major Depression Recurrent, Carpal

20 Tunnel Syndrome and Muscle Spasms.  DR. STERNER deems the use of

21 cannabis helpful to CRAIG CANADA for this treatment of these chronic

22 conditions.  He recommends CRAIG CANDA to use approximately five grams

23 of cannabis per day, as needed.  On November 25, 2003, the Plaintiff,

24 BONITA MILLARD, with full knowledge of Defendant CRAIG CANADA'S

25 medical condition as well as his documented, legal use of marijuana,

26 informed the Morongo Valley Sheriffs Department that he, CRAIG CANADA,

27 was engaging in the unlawful cultivation and use of marijuana.  CRAIG

28 CANADA was subsequently arrested for his actions.
