3       THE COURT: That would be appropriate. Let's

4  continue this matter for a period of four weeks.

5  Is that acceptable?

6       MR. SASNETT: It is acceptable to us your Honor.

7       THE COURT: 17th of March at 1:30.

8       MR. SASNETT: Yes.

9       THE COURT; At that point we can have final argument

10 on this matter and then I'll give you a ruling.

11      MR. ADAMS: Is there a time waiver?

12      Mr. SASNETT: Mr. Canada, the Court advised you that

13 you have a right to a continuous preliminary hearing.

14 That means you have a right to have a decision from the

15 court today.

16      As I have mentioned to you I think It might be

17 advantageous for the parties to brief their respective

18 positions and give the Court the benefit of those thoughts

19 before he rules on whether or not to hold you to answer.

20      To do that you have to waive two rights. One is

21 to a continuous preliminary hearing.

22      Do you understand that right?

23      THE DEFENDANT: Yes.

24      MR. SASNETT: Do you waive and give up that right?

25      THE DEFENDANT: Can I ask a question?

26      THE COURT: No, ask Mr. Sasnett.

27 (Counsel and his client confer.)

28      THE COURT: I have reconsidered my position on this.
