called me a short time later and informed me the subject CANADA had allowed him back inside the
apartment but was now becoming uncooperative with the search and seizure of the marijuana plants.
I asked Dep. WOLFE is he could freeze the scene and I would be arriving there shortly and possibly
obtaining a search warrant for the location. At approximately 2200 hours, I arrived at the location.,
contacted Dep. WOLFE who tole me the subject was definitely uncooperative now and that he was
still seated in the living room of the residence, however, was not allowing him to collect search and
seize any property. I told Dep. WOLFE at this time I would be seeking a search warrant based on his
training and experience in what he had observed and what the subject had told him in regards to the
suspected marijuana.
I was contacted by Sgt. SANDERS, the Watch Commander from the Morongo Basin Sheriff's Station,
while at the location. Sgt. SANDERS told me that after allowing deputies back into the residence he
attempted to use a video monitor hooked to a personal computer to video tape them as they entered
along with audio. Sgt. SANDERS told me that drew his attention to the personal computer; in
particularly the screen monitor. He told me he was able to observe what appeared to him to be a
detailed growth chart on each plant of marijuana possibly for the ones inside the residence.
However, when the suspect CANADA noticed Sgt. SANDERS looking at the screen he immediately
was able to change the screen and therefore not allow Sgt. SANDERS to read any further details
about that particular item that was showing on the screen.
SEARCH WARRANT:
After completing a probable cause and search warrant affidavit I contacted Superior Court Judge
James MCQUIRE at his home residence. A faxed search warrant was sent to Judge MCQUIRE after
being sworn by phone Judge MCGUIRE then authorized the warrant and affidavit.
